Has Your Schedule Been Changed? You Deserve The Proper Notice
July 23, 2010
The union is receiving an increased number of complaints from SOF members who aren’t receiving the proper notification of schedule changes.
Your employer is obligated, under the collective agreement, to verbally advise you of any changes they have made to your schedule – an email does not constitute "notice!" This is a clear violation of Section 5.06 of your contract.
Don’t let your employer attempt to convince you that an email is a sufficient way to communicate changes to your schedule. It is not. Emails are NOT always read the moment they are sent, and therefore do not provide you with the proper notice.
If your schedule is changed, and you do not receive 24 hours notice, you are entitled to four additional hours of pay.
Service Clerks and students must be notified the day before, or are entitled to an extra two hours pay.
The union will file grievances on behalf of our members who have not received notice pursuant to section 5.06.
Section 5.06 of the Save–On-Foods Collective Agreement:
5.06 Weekly Work Schedules
An employee's schedule may be changed without notice in the event of absence of other staff due to sickness or accident or in the event of emergencies, such as fire, flood, breakdown of machinery or other instances of force majeure. In all other cases, at least twenty-four (24) hours' notice of any change must be given or four (4) additional hours' pay given in lieu of notice.
The Employer is required to make a reasonable effort to verbally advise individual employees of the changes to their work schedule once it has been posted.
A student's schedule may be changed without notice in the event of absence of other staff due to sickness or accident or in the event of emergencies, such as fire, flood, breakdown of machinery or other instances of force majeure.
In all other cases, a student must be notified on the day before of any change to his or her schedule or be given an additional two (2) hours' pay if the schedule is changed for a non-school day.
A service clerk's schedule shall not be changed without notice except in the event of absence of other staff due to sickness or accident, or emergencies such as fire, flood, breakdown of machinery, or other such instances of force majeure. In all other cases, a service clerk must be notified on the day before any change to his or her schedule or be given an additional two (2) hours' pay.
It is understood that if a penalty is paid under this subsection 2, then no penalty shall be paid under Section 7.05.
